In the Matter of

RUTH ANN WEIDEL,
    Complainant

    v.

U.S. DEPARTMENT OF JUSTICE
    Respondent

Docket No. 2000-CAA-0002

ORDER

On December 8, 2000, I issued a Recommended Order of Dismissal in this case based on complainant's motion of withdrawal. Hours after that order was issued, respondent filed a response to complainant's motion requesting any order of dismissal be with prejudice.

Regardless of whether a dismissal with prejudice may be appropriate, any order dismissing this case would be a de facto dismissal with prejudice, since the time for filing a complaint based on the alleged acts of discrimination expired a long time ago. Accordingly, there is no reason to reconsider my Recommended Order of Dismissal
