This case arises under the Surface Transportation Assistance Act of 1982 (STAA) (49 U.S.C. 2305), based upon a complaint filed by Complainant on February 7, 2000. A notice of hearing was issued on April 27, 2000 scheduling a hearing for May 30, 2000. The matter was assigned to the undersigned on April 26, 2000. Upon May 24, 2000 notification of counsel for Respondent that Respondent ("KTL, Inc." herein incorrectly named "KTL Trucking Company") has filed a petition for bankruptcy, an Order to Show Cause Why Matter Should Not Be Dismissed was issued on June 12, 2000 requiring response on or before June 27, 2000. No response to this order has been filed.
Accordingly, pursuant to the automatic stay provision of 11 U.S.C. 362 and Torres v. Transcon, Case No. 90-STA-29 (1/30/91), I recommend this matter be DISMISSED.
