ORDER OF CONSOLIDATION

    On December 31, 1996, Respondent appealed the OSHA determinations in the above-captioned matters to this Office. In the notice of appeal, Respondent requests that these matters be consolidated with Case No. 97-ERA-14, which is presently scheduled for hearing before Administrative Law Judge C. Richard Avery on March 31, 1997. On January 7, 1997, Complainant's counsel, Tom Carpenter confirmed that he did not oppose this motion.

    Pursuant to 29 C.F.R. § 18.11, when two or more hearings are to be held, and the same or substantially similar evidence is relevant and material, the matters may be consolidated. There being good cause shown, IT IS HEREBY ORDERED that the above-captioned matters be consolidated and assigned to Judge Avery.
