   This proceeding arises from a complaint filed by Donald Matthews, Complainant, against the Respondent, Apartment Investment and Management Company, alleging a violation of Section 806 of the Corporate And Criminal Fraud Accountability Act of 2002, Title VIII of the Sarbanes-Oxley Act of 2002, 18 U.S.C. § 1514A.

   On or about January 28, 2004, I received a joint letter from counsel for both parties advising me that the parties have reached a settlement of this matter and asking that the matter be dismissed. In view of the resolution of this matter and the parties' joint request, it is hereby ORDERED that this matter be DISMISSED WITH PREJUDICE.
