and DISMISSING COMPLAINT This proceeding arises under the employee protection provisions of Section 405 of the Surface Transportation Assistance Act ("STAA") of 1982, 49 U.S.C. § 31105, and the implementing regulations promulgated thereunder, 29 C.F.R. Part 1978. On May 12, 2003, the parties submitted an executed Settlement Agreement and Release of claim in final disposition of the case. The agreement has been executed by the parties and has been submitted for approval to the undersigned. The Settlement Agreement and Release is attached and is made a part of this decision. This Administrative Law Judge, having carefully reviewed the Settlement Agreement and Release, concludes that this settlement is a fair, adequate and reasonable settlement of the complaint and it is therefore ORDERED that the settlement agreement shall be, and the same hereby is APPROVED pursuant to the provisions of 29 C.F.R. § 1978.111(d)(2), and that this case is hereby DISMISSED with Prejudice.
