ORDER

    I have received two letters from the Complainant in this case. The first, dated February 17, 1988, requested that the Department of Labor represent the Complainant, and that the hearing in the case, then scheduled for March 24, 1988, be indefinitely postponed. The second letter, dated March 7, 1988, reiterated the request for more time and asked that the. case be assigned to a court of appeals other than the United States Court of Appeals for the Fifth Circuit. In addition, I take note that the Administrative Law Judge (ALJ) at first issued an order on March 22, 1988, dismissing this case, and vacated that order on March 30, 1988. The ALJ then issued an order on March 31, 1988, scheduling the case for trial on October 24, 1988.

    Complainant's requests1 are in the nature of an interlocutory appeal and are therefore denied. See Shusterman v. Ebasco Services, Inc., Case No. 87-ERA-27, Secretary's Order issued July 2, 1987; cf. Malpass and Lewis v. General Electric Co., Case No. 85-ERA-39, Secretary's Order issued December 20, 1985.

1 It does not appear that Complainant's letter of March 7, 1988 was served on Respondent. A copy of that letter with attachments is appended to this letter to effectuate service.
