ORDER DISMISSING CASE

    The Administrative Law Judge (ALJ) in this matter arising under the employee protection provisions of the Energy Reorganization Act of 1974, as amended (the Act), 42 U.S.C. § 5851 (1982), issued an Order of Dismissal at the Plaintiff's Request on April 21, 1987. The ALJ's Order was forwarded to me together with the record in the case on June 20, 1988.

    The ALJ did not refer to any provision of Department of Labor regulations under which he purported to issue the order of dismissal. However, it appears that the circumstances of this case fall within the provisions of 29 C.F.R. § 18.39(b) (1988), Dismissal-Abandonment by Party, and that dismissal of this case is appropriate. Accordingly, this case is DISMISSED.
