ORDER GRANTING LEAVE TO FILE
RESPONSE TO AMICUS BRIEF

   On June 6, 1989, I issued a Briefing schedule in this case allowing the parties 40 days from receipt of the order to submit briefs in support of or in opposition to the Administrative Law Judge's (ALJ) Recommended Decision and Order. Reply briefs were to be submitted within 40 days of receipt of initial briefs.    Complainant John C. Rex filed and served on Respondent his initial brief. Respondent filed a brief in response to Complainant's Brief. On November 14, 1989, I granted complainant's motion for leave to file a reply to Respondent's brief. In the same order of November 14, 19891 I granted the

motion of the Wage and Hour Administrator for leave to file an amicus brief addressing an issue in the case. Respondent moved on December 14, 1989, for leave to file a response to the amicus brief of the Wage and Hour Administrator. A copy of the response was attached to the motion. Respondent's motion is granted and the response is received.
