FINAL DECISION AND ORDER

   This matter arises under the employee protection provision of the Energy Reorganization Act of 1974, as amended (ERA), 42 U.S.C. § 5851 (1982). Before me for review is the [recommended] Order of Dismissal issued on January 20, 1987, by Administrative Law Judge (ALJ) Ronald T. Osborn. The record reveals that prior to a hearing on his complaint, Complainant notified the ALJ by letter dated January 5, 1987, that he wished to dismiss with prejudice his action against Hatfield Electric Company.

   Upon review of the record in this case and the [recommended] Order of Dismissal, I accept the ALJ's recommendation. Accordingly. the complaint in this case is hereby dismissed with prejudice.
