   The parties to the above proceeding brought pursuant to the Energy Reorganization Act of 1974, have entered into a settlement agreement signed in counterpart, which is incorporated by reference as though fully set forth herein.

   I find that the terms of the settlement are fair, adequate and reasonable, and IT IS RECOMMENDED that the Secretary enter a final order approving the settlement agreement instanter, and upon, execution thereof, to order dismissal of the complaint with prejudice.
