RECOMMENDED ORDER OF DISMISSAL

   On January 13, 1990, H. Shannon Phillips, Complainant, filed a claim under the Energy Reorganization Act, 42 U.S.C. § 5851. On February 1, 1991, the Wage and Hour Division, Employment Standards Administration, Department of Labor, denied the complaint, and Complainant appealed to this Office. On February 25, 1991, Complainant moved to withdraw and dismiss this cause with prejudice. Respondent has no objection.

   In these circumstances, I see no reason why the motion should not be granted. Accordingly,

   It is ORDERED that this proceeding is DISMISSED with prejudice.
