ORDER DENYING COMPLAINANT'S MOTION
TO COMPEL DISCOVERY

   By letter dated January 18, 1991, addressed to the Chief Administrative Law Judge, Complainant, pro se, filed copies of interrogatories and requests for production of documents served on Respondent, together with a motion for an order compelling discovery.

   As Respondent's counsel points out in his letter of February 7, 1991, a recommended order of dismissal was entered in this case on September 4, 1990, and the matter is now before the Secretary of Labor. For this reason, Complainant's motion to compel discovery must be, and is hereby, denied. The materials submitted by both parties will be forwarded to the Secretary of Labor.
