   On December 15, 1989 Complainant Robert Rogers filed a complaint with the Secretary of Labor for an alleged violation of the Federal Water Pollution Control Act. Complainant alleged that he was unlawfully fired by Respondent for reporting to the Colorado Department of Health that Respondent did not comply with the Federal Water Pollution Control Act.

   The matter was set for hearing on May 11, 1990 in Denver, Colorado. On the eve of the hearing parties advised me by telephone that they reached a settlement. A copy of the agreement embodying the settlement has since been submitted and it is attached hereto.

   It appearing that the settlement is fair, adequate, reasonable, and not against public interest, it is recommended that the Secretary of Labor approve it.
