_______ |GRANTED| _______ OFFICE OF ADMINISTRATIVE LAW JUDGES CINCINNATI, OHIO Judge: RUDOLF L. JANSEN Date: 1-25-91
Case No. 90-ERA-10 IN THE MATTER OF:
MANSOUR GUITY,
VS.
TENNESSEE VALLEY AUTHORITY,
Complainant Mansour Guity and respondent Tennessee Valley Authority (TVA) jointly move through their respective counsel for a continuance of the trial of the case currently set for April 30, 1991, and as grounds for said motion set forth the following: 1. By joint motion granted on September 5, 1990, the parties informed the Honorable Rudolf L. Jansen of the pending federal case, Mansour Guity v. Tennessee Valley Authority, No. 3-87-843 (E.D. Tenn.) and of the mental problems experienced by the complainant. 2. The mental problems have continued to prevent setting the federal court case. 3. The parties agree that trial of [Page 2] this proceeding at this time under the circumstances now present would not be appropriate and that the trial of this proceeding should be continued until ninety (90) days after the proceedings in the district court in No. 3-87-843 have been completed; and 4. The parties agree to immediately notify the Administrative Law Judge of the date when No. 3-87-843 is set for trial or dismissed without trial, and at that time to suggest discovery cut-off dates for this proceeding. 5. The parties waive all time constraints required by the law and/or regulations. Respectfully submitted,
