FINAL ORDER OF DISMISSAL
Before me for review is the Recommended Order Dismissing
Complaint (R.0.) issued by the Administrative Law Judge (ALJ) in
this case arising under the employee protection provision of the
Surface Transportation Assistance Act of 1982 (STAA), 49 U.S.C.
app. § 2305 (1988). The ALJ recommended dismissal of the
complaint because Complainant failed to show good cause for his
failure to appear at the rescheduled hearing.
Complainant has not responded to my Order to Show Cause why
this complaint should not be dismissed for failure to appear at
the hearing.
Accordingly, I accept the ALJ's R.O. and the complaint is
dismissed.
