                         FINAL DECISION AND ORDER

     Before me for review is the [Recommended] Order of Dismissal
(R.O.D.) issued by the Administrative Law Judge (ALJ) in the
captioned case, which arises under the employee protection
provision of the Surface Transportation Assistance Act of 1982
(STAA), 49 U.S.C.A. § 31105 (West 1994).  
     The ALJ has recommended that the case be dismissed because
Complainant failed to comply with his procedural orders.  29
C.F.R. § 18.6(d)(2)(v)(1994).  Upon review of the record, I
agree that dismissal is appropriate.  Accordingly, I adopt the
ALJ's R.O.D., copy appended.  The complaint is dismissed.
