ORDER OF DISMISSAL

     This matter is before the undersigned based on a complaint
filed by Michael Ray Robinson alleging that Marten Transport, Inc.
violated certain provisions of the Surface Transportation Assis-
tance Act of 1982.  Pursuant to the request of the parties a
previously scheduled hearing was continued and the matter held in
abeyance pending consideration of a collateral claim filed with the
State of Wisconsin, Workers' Compensation Division.
     On January 18, 1994, the parties, in a telephone conference
with the undersigned advised that they had resolved the issues
between them.  On the same date, the Complainant, by counsel, filed
a motion for dismissal of this action averring that the claim had
been resolved in another forum.  Accordingly, as there are no
issues to be resolved by the undersigned,
     IT IS ORDERED, that the complaint in this matter be, and it
hereby is, DISMISSED, with prejudice.
