  ORDER APPROVING SETTLEMENT AND DISMISSING COMPLAINT

     Pursuant to the remand order of the Secretary of Labor,
dated December 7, 1993, a reopened hearing in this matter under
§405 of the Surface Transportation Act of 1982 was scheduled
for February 22, 1994 in St Louis, Missouri.   The parties
appeared at the appointed time, in person and by counsel, and
announced that they have reached a settlement disposing of all
issues raised in the complaint.  In accordance with my
instructions, the terms of the agreement have been reduced to
writing and have been submitted to me for approval.
     This case has a protracted history.  There remained true
justiciable issues which were in dispute and which were neither
frivolous nor unsubstantial.  The parties have been represented
by good and knowledgeable counsel.  Based on my interrogation of
the Complainant, I am satisfied that he fully understands the
terms of the agreement and accepts the same without reservation.
I conclude also that the proposed settlement is in the best
interest of both parties.
     Accordingly, pursuant to the authority contained in 29
C.F.R. §1978.111 (2), it is Ordered that the settlement be
approved and that the complaint in this matter be dismissed.
