ORDER

    Complainant, Joe Dinkins ("Dinkins") and Respondent, Bull Market, Inc. ("Bull Market") have submitted an agreement of settlement and compromise requesting that Dinkins' Complaint be dismissed. Upon review of the Complaint, the notice of administrative determination and the agreement of the parties, the Court finds as follows:

    1. No violation of the hours of service regulations, codified at 49 C.F.R. § 395.1, et seq., occurred, and further, Dinkins' employment with Bull Market was not terminated in violation of 49 U.S.C. § 31105.

    2. This Order shall have the same force and effect as an order made after a full hearing.

    3. This Court recommends to the Secretary of the Department of Labor that the Complaint of Dinkins should be dismissed.
