In the Matter of Jenkins, ERA-102 (Sec'y Nov. 27, 1979)

UNITED STATES OF AMERICA
DEPARTMENT OF LABOR
CASE NO. ERA-102

In the Matter of

KENNETH M. JENKINS

O R D E R

Kenneth M. Jenkins filed a complaint alleging discrimination against him in his employment by the Watts Bar Nuclear Plant, Tennessee Valley Authority because of activities to carry out the purposes of the Energy Reorganization Act of 1974, as amended, in violation of Section 210 of that Act (92 Stat. 2951; 42 U.S.C. 5851).

An investigation of the allegations revealed that they were unfounded and that no violation of Section 210 of the Act was committed.

Mr. Jenkins and the Watts Bar Nuclear Plant, Tennessee Valley Authority, were advised of the results of the investigation, and an opportunity for a hearing was offered. Neither party has requested a hearing.

Accordingly, I find that is has not been shown that section 210 of the ACT was violated as alleged, and the complaint is hereby dismissed.

Dated at Washington, D.C. this 27th day of Nov., 1979
