REMAND ORDER

    The United States Court of Appeals for the Fourth Circuit remanded this case for consideration of complainant's "separate claim of discrimination by retaliatory harassment." English v. Whitfield, No. 87-3520, slip op. at 18 (Oct. 6, 1988). The Court of Appeals upheld the Secretary's decision that Complainant's other, independent claim of retaliatory discharge was time barred. Id. at 12-13.

    Accordingly, this matter is REMANDED to the Administrative Law Judge for further proceedings consistent with the order of the Court of Appeals.
