James v. Dresser-Atlas Division, 84-ERA-28 (Sec'y Mar. 17, 1988)

U.S. DEPARTMENT OF LABOR

SECRETARY OF LABOR
WASHINGTON, D.C.

DATE: March 17, 1988
CASE NO. 84-ERA-28

IN THE MATTER OF

DANIEL JAMES,
    COMPLAINANT,

v.

DRESSER-ATLAS DIVISION,
    RESPONDENT.

BEFORE: THE SECRETARY OF LABOR

ORDER

On October 28, 1987, the Secretary issued an "Order to Submit Settlement Agreement" to the parties in this case to determine whether the terms of the settlement agreed to should be approved. Pursuant to that order the parties have filed a "Stipulation Re: Settlement Agreement" which includes, by attachment, the "Full Release of All Claims" (Release) executed by Complainant Daniel James and his attorney, Rand MacDonald, and pages 23-27 of the transcript of hearing held on October 22, 1986, before Administrative Law Judge (ALJ) Alexander Karst. The release and transcript incorporate the terms of the settlement. I note that the ALJ gave his approval to the settlement, considering "it

the best result under the circumstances." Transcript at 27.

The terms of the settlement agreement have been thoroughly reviewed and I find them to be fair, adequate and reasonable and therefore, approve the settlement.

Accordingly, the complaint in this case is DISMISSED.

    SO ORDERED.

       ANN MCLAUGLIN
       Secretary of Labor
