                     RECOMMENDED ORDER OF DISMISSAL

     Came on this date to be considered the Order Granting
Respondent's Motion to Stay Proceedings entered May 3, 1994.  Prior
to entering this Order, the Court has also reviewed the pleadings
of the parties, including Complainant's response to Order Stay
Proceedings filed June 29, 1994.  For the reasons contained in the
Order entered May 3, 1994, the Court remains of the opinion that
Complainant is not entitled to further proceedings in connection
with this case since restitution has not been made.

     It is therefore ORDERED, ADJUDGED and DECREED
that this case is hereby DISMISSED WITH PREJUDICE
for lack of prosecution.
