    This proceeding under the Energy Reorganization Act of 1974, as amended, 42 U.S.C. § 5851, was referred to the Office of Administrative Law Judges pursuant to request for hearing filed by original Respondent, Ellis Fischel State Cancer Hospital of Missouri on September 12, 1984.

    A hearing was scheduled for October 3, 1984 before the

undersigned. A hearing was in fact held on October 3 and 4, 1984 and was to be continued on October 16, 1984.

    On October 15, 1984, the parties executed, and filed a signed copy of a settlement agreement, a copy of which is attached hereto, which effected a compromise and settlement of the issues in the above-captioned proceeding. (The title has been amended from Clifford Richter v. Ellis Fischel State Cancer Hospital of Missouri to Clifford Richter v. Missouri State Cancer Commission.)

    Pursuant to the settlement agreement the parties have stipulated that this case has been settled and may be dismissed with prejudice, each party to bear its own attorneys fees and costs.

    Accordingly, it is ORDERED that the above-captioned case is DISMISSED WITH PREJUDICE.
