renovation of the concession/cafeteria property at
the Veterans Administration facility in Northport,
New York

ORDER OF REMAND
The Wage Appeals Board, United States Department of Labor,
is in receipt of the Wage and Hour Division Administrator's
motion for remand filed in the captioned matter. In support of
the motion for remand, the Administrator urges that the Wage and
Hour Division letter from which appeal was sought is not a "final
ruling" within the meaning of the Board's rules of practice.
Accordingly, the Administrator requests in her motion "that the
Board remand this matter to the Administrator for the issuance of
a final ruling pursuant to 29 C.F.R. 5.13, to be issued within 10
days of the Board's remand order." Motion at 3. For good cause
shown, it is hereby
Ordered, that this matter is remanded to the Administrator,
Wage and Hour Division for further consideration and issuance of
a final ruling within 10 days of the date of this Order. The
Administrator is directed to provide the Board a copy of the
ruling on remand on the date of issuance. The parties and
interested persons are advised that the Board will issue a new
briefing schedule upon issuance of the final ruling.
