Cozad, Nebraska PETITIONER DECISION AND ORDER On September 17, 1973, a Petition was received in the office of the Wage Appeals Board from the above Petitioner seeking review of the hourly wage rate predetermined by the Employment Standards Administration (ESA) of the Department of Labor for carpenters on the Broken Bow Housing Project. Petitioner considered the $4.98 hourly rate predetermined as in excess of the rate prevailing in the Broken Bow area and sought to have the rate reviewed and reduced pursuant to certain payment evidence made a part of his Petition. [1] ~2 [2] On September 21, 1973, Petitioner was notified that the matter had been referred to the Wage Appeals Board for its consideration and that he would be advised as soon as possible as to any further action deemed warranted. Informational copies of this notification were furnished a schedule of interested parties, including the Omaha and Washington Offices of the Department of Housing and Urban Development and Counsel for ESA, and Petitioner was sent a copy of the schedule. It has been determined that the Federally-assisted contract here involved was awarded on July 3, 1973 and that construction thereon began July 9, 1973, both of which dates preceded the submission and receipt by the Board of the Petition for review in this case. Under the circumstances of this case no further action by the Board is warranted and the case has been closed. ORDER: The Petition is denied. (s) Oscar S.
