[1] BOARD OF SERVICE CONTRACT APPEALS
UNITED STATES DEPARTMENT OF LABOR
WASHINGTON, D. C.
In the Matter of:
METROPOLITAN DISTRICT COUNCIL BSCA Case No. 94-13
OF PHILADELPHIA AND VICINITY,
UNITED BROTHERHOOD OF CARPENTERS
AND JOINERS OF AMERICA
With respect to review and reconsideration of
Wage Determination No. 94-2449 with and its
application to a General Services Administration Contract
for disassembling and reassembling metal shelving at the
National Archives, Philadelphia, Pennsylvania
DATED: January 30, 1995
ORDER OF DISMISSAL
The Board of Service Contract Appeals, United States Department of Labor, is in receipt
Petitioner's January 20, 1995 letter, noting that Respondent Administrator, Wage and Hour
Division had indicated its intentions to revise the wage determination [and final ruling of
December 9, 1994] and requesting the Board to hold this matter in abeyance until the revised
wage determination is issued. The Administrator has this date filed a Motion to Dismiss, on the
ground that she has reconsidered the December 9, 1994 final ruling and now agrees with
[Petitioner]. . . . The Administrator further avers that she has issued to [the General Services
Administration] a letter . . . requesting that GSA incorporate a new wage determination in the
captioned contract. The Administrator notes that since Petitioner has been granted the relief
requested in its petition for review, the appeal is now moot. Having considered the
Administrator's Motion to Dismiss and Petitioner's prior request to hold this matter in abeyance,
it is hereby
Ordered, that the captioned matter is dismissed without prejudice.
