ORDER
More than five (5) years have elapsed since the violations of
the Service Contract Act which are the basis for this proceeding.
In support of its appeal to the Secretary Respondents have alleged
that they have been in compliance with the Act during this period.
Respondents have also submitted letters from the union representing
its employees and from an employee who was a victim of the
violations tending to demonstrate Respondents' capacity and
willingness to comply with the Service Contract Act, a factor to be
considered in a finding of unusual circumstances for relief from
the debarment provision of Section 5(a).
I am therefore directing an investigation of Respondents by
the Wage and Hour Division as soon as practicable to determine
whether in the interim they have complied with the Service Contract
Act. The results will be accorded consideration in my evaluation
of whether unusual circumstances exist to relieve Respondents from
the penalty of debarment.
