    This case arises under the McNamara-O'Hara Service Contract Act of 1965 (SCA), as amended, 41 U.S.C. § 351 et seq., the Contract Work Hours and Safety Standards Act(CWHSSA) as amended, 40 U.S.C. 327 et seq., and the regulations issued thereunder at 29 C.F.R. Part 4.

    On September 6, 1996, the Department of Labor (DOL) filed with this Office a Motion to Withdraw Complaint. DOL informed this Office that Respondent is not longer in the mail-hauling business and that back wages have already been paid. DOL therefore request that they be allowed to withdraw its Complaint and close this matter.

    Accordingly, this matter is hereby DISMISSED.
