NOTICE OF ASSIGNMENT AND ORDER

   PLEASE TAKE NOTE that the above-captioned matter, a case brought under the Job Training Partnership Act (JTPA) (formerly 29 U.S.C. § 1501 et seq. [repealed], 20 C.F.R. Parts 626 to 638) has been assigned to the undersigned administrative law judge for disposition. The parties have submitted briefs concerning jurisdiction, in accordance with Associate Chief Judge Thomas M. Burke's Order of October 1, 2001, and the preliminary jurisdictional issue will be resolved before a hearing is noticed. No further briefing is required. However, the parties shall have thirty (30) days from this Notice of Assignment and Order to file any responses to the memoranda that have been filed. Specifically, the parties are invited to state their positions on the arguments made by the other parties, including the suggestion that this matter be remanded back to the federal Grant Officer for consideration of the complaint and issuance of a final determination.
