ORDER GRANTING DISMISSAL

   This case arises under the Job Training Partnership Act (JTPA), 29 U.S.C. § 1579 et seq, and the applicable regulations issued at 20 C.F.R. Part 626.

   On June 1, 2000, the Department of Labor (DOL) notified Complainant of an assessment owed regarding a Final Determination on an audit of its JTPA program. On June 23, 2000, Complainant filed a request for hearing in this Office. On July 24, 2000, this Office issued a Pre-Hearing Order which required both parties to file certain information regarding this case. DOL filed a response to the Pre-Hearing Order on August 17, 2000. Complainant filed a response to the Pre-Hearing Order on November 2, 2000.

   Thereafter, on April 12, 2001, the parties filed a Joint Stipulation of Dismissal with Prejudice which states that the parties entered into a Settlement Agreement on April 10, 2001 which resolves this matter. Accordingly, this case is dismissed with prejudice.
