Model Language
Federal agencies are required by the Energy Policy Act of 2005 (P.L. 109-58), Executive Order 13123, and Federal Acquisition Regulation (FAR) Section 23.203 to incorporate the performance criteria used for ENERGY STAR®-qualified and FEMP-designated products into procurement contracts for energy consuming products and systems. These include guide and project specifications; construction, renovation and service contracts; and the evaluations of offers.
