Section 106 Review and Compliance
In cooperation with the federal Advisory Council on Historic Preservation (ACHP), the State Historic Preservation Office (SHPO) works with federal agencies to assist them in complying with Section 106 of the National Historic Preservation Act of 1966. This legislation permits the SHPO Section 106 Review and Compliance program to review federal undertakings--both archaeological (or below-ground) and above-ground--for their impacts on cultural resources.

From construction of new roadways and bridges to dredging of waterways, from the rehabilitation of a CCC-era Coast Guard station to the installation of cell tower equipment, the Review and Compliance program assists clients to identify and evaluate resources, assess effects upon those resources and look for productive ways to avoid or mitigate adverse project effects.
 
Our Review and Compliance team actively works with tribal governments and local communities, particularly Tribal Historic Preservation Offices and Certified Local Governments respectively, to assist in these endeavors.

The Oregon SHPO is making a transition from a paper-based Section 106 compliance process to a standardized electronic format based on Microsoft Access. This system is explained in the publication Guidelines for Conducting Historic Resource Surveys in Oregon available below. A sample Section 106 report using the new format is also available. Please note that the sample should be used in conjunction with the handbook.
 
As part of this new system, agencies are asked to follow a four-step process.
  1. Contact SHPO staff members Dr. Stephen Poyser or Sarah Jalving to begin the consultation process and obtain a project number . Those calling should be able to discuss the Area of Potential Effect (APE), project undertaking, and the potential effect(s) of the work in addition to supplying basic contact information. Consultation ideally involves SHPO staff, the agency contact person, and the individual completing the work.
  2. Obtain a copy of the Oregon Sites Database from the office. Databases should be requested no more than 30 dyas before a project begins.
  3. Complete survey work.
  4. Submit data to the SHPO for review.
