2560 Revocation of Power of Attorney and Withdrawal of Attorney [R-5]

The revocation or withdrawal of an attorney may be submitted at any time; however, it is recommended that it be done well prior to the date a maintenance fee is due.

When processing a revocation of a power of attorney, the Office of **>Initial Patent Examination< forwards copies of the completed action to the requester and the attorney being removed. Also, a copy is placed in the original file .

When processing a withdrawal of an attorney, the Office of **>Initial Patent Examination< forwards copies of the completed action to the attorney and the patent owner.

It should be noted that an assignment does not act as a revocation of power of attorney for authorization previously given. However, the assignee may revoke a previous power of attorney. See 37 CFR 3.71 and 3.73.
