Rare native plants in Oregon are protected on all non-federal public lands (state, city, county, etc.) under the Oregon Revised Statute 564.105. This legislation places the responsibility for conservation of native plants with the Oregon Department of Agriculture (ODA) under Oregon Administrative Rules 603-073 . These rules include the current list of Oregon's Threatened and Endangered (T/E) plants, and specify requirements for adding or removing plants from this list. Procedures for citizens wishing to petition ODA to list a new plant, reclassify a plant, or remove plants from the list are also included.
The petitioning process is intended to allow ODA to amend the T/E list in response to documented scientific evidence of increasing or decreasing threats to native plants as presented by Oregon citizens. Once a petition has been received by ODA, the agency is responsible for utilizing the criteria described in the rules to evaluate the evidence presented, and (providing the evidence is sufficient) commence the process of listing, reclassification or delisting as requested. Petitions which include all required information allow straight forward evaluation of the requested action “based on documented and verifiable scientific information about the species' biological status,” and make ODA's subsequent determination to list, delist or reclassify easily justifiable.

In order to be considered for listing as threatened or endangered in Oregon , a plant species must meet all of the following criteria:

Name and description validly published or accepted for publication.

Native to Oregon
-
Likely to become endangered within the foreseeable future throughout all or any significant portion of its geographic range

Natural reproductive potential in danger of imminent or continual failure
In addition, any listed species must also face at least one of the following threats:

Most of the species' populations are undergoing imminent or active deterioration of range or habitat

An over-utilization of the species or its habitat is likely to occur
-
Existing state or federal programs and regulations are inadequate to protect the species or its habitat

| Listing/delisting petition process |
|
A petition to list/delist an Oregon plant is submitted to:
Director
Oregon Department of Agriculture

Within 30 days of receiving petition: Director acknowledges the submission of petition in writing
Within 90 days of receiving petition: Director notifies petitioner in writing whether or not there is sufficient scientific evidence to proceed
Within two years of receiving petition: Director notifies petitioner of the final determination and the reasons for that determination. If the Director denies the petition, petitioner may seek judicial review.

| Listing/delisting petition format |
|
A petition to list, reclassify, or delist a plant in Oregon must include:
- Scientific name, authority, common name of the plant
- Procedure requested (listing, reclassification, or delisting)
- Documented scientific evidence to support request
- An opinion of the status of any outstanding taxonomic problems or questions for the species, given by a professional taxonomist
- A detailed discussion of the current or anticipated destruction, modification or curtailment (or lack thereof) of the species' habitat and/or geographical distribution
- A description of the species' historical and present distribution
- A detailed description of threats posed to the species
- Any changes in the species' distribution or in the threats facing this species, and the reason for the change
- Current land conservation practices, and what the effect is (whether positive or negative) they have on this species' habitat
- Measures that have been/could be taken to alleviate reduction of the species' habitat and/or range
- An analysis of existence (or lack) of present or threatened failure of the species' natural reproductive potential
- An estimated number of populations and number of individuals per population (including documentation of all field inventories)
- Any documented or suspected changes in population size and the reasons for the change
