ORS 279C.836 requires that all independent contractors working on qualifying public works projects, with a contract price that exceeds $100,000 must obtain and file with the Construction Contractors Board (CCB) a public works bond with a corporate surety authorized to do business in Oregon for the amount of $30,000 before starting work on a contract or subcontract for a public works project.
 
Licensed CCB Contractors: You will be required to sign the bond supplied by your bonding agent. Once signed, submit the original bond directly to the CCB by mail or in person.
 
Contractors not required to be CCB licensed: You will be required to sign the bond supplied by your bonding agent. Once signed, submit the original bond along with the completed Non-Construction Company Filing Statutory Public Works Bond with CCB form to the CCB by mail or in person.
 
Disadvantaged, minority, women or emerging small business may elect to be exempt from filing the public works bond for up to four years from intial certification that is obtained from the Office of Minority, Women and Emerging Small Business (OMWESB).Click here to find out more about the OMWESB program.
 
If your business has elected to utilize the OMWESB exemption for the public works bond, you must submit to the CCB the form, Disadvantaged, Minority, Women, or Emerging Small Business Enterprise Exemption from $30,000 Public Works Bond. You may mail or deliver in person the form and supporting certification to the CCB office.

What is this bond used for?
This bond will be used solely in the event of a prevailing wage claim filed with the Bureau of Labor and Industries (BOLI). 

Will this bond replace my CCB license bond?
No. This bond is separate and is required in addition to any other bond a contractor or subcontractor is required to obtain.

Are there exemptions from the requirement of having to file the public works bond?
Yes. You may be exempt for any of the following:
  • You are exempt from the bond if you are not required to pay prevailing wages under ORS 279C.800 to 279C.870.
  • Bonding requirements may be exempt in cases of emergency as declared under ORS 279A.065.
  • If the business is certified by the Office of Minority, Women and Emerging Small Business (OMWESB) the business may elect to be exempt from the bond requirement during the first year of initial certification only. After four years from intial certification, a public works bond must be filed with the CCB before starting or continuing work.

Where can I get this bond?
Contact your insurance agent, current bonding company or look in the yellow pages for bonding companies.

If I'm not a CCB licensed contractor do I still need this bond?
Yes. If you are planning to contract or subcontract for a public works project you are required to file the publics work bond with the CCB. You must also provide the information requested in the form Non-Construction Company Filing Statutory Public Works Bond with CCB.

Where do I submit my forms and/or original bonds?
Forms and original surety bond may be mailed to PO Box 14140 Salem, OR 97309-5052. In person, our office is located in Salem at 700 Summer St NE Suite 300 (Veteran’s Building).

Can I fax any of the information?
No. We require the original bond and request the documents either by mail or in person.

Where can I get the bond form?
Your bonding company may download the bond form from the BOLI website at the following address:
