Children's Educational Television
On August 8, 1996, the Commission adopted a Report and Order amending its children's educational and informational television programming requirements to strengthen its enforcement of the Children's Television Act of 1990 ("CTA"). First, the Commission adopted requirements designed to provide better information to the public about the shows broadcasters air to fulfill their obligation under the CTA to air programming "specifically designed to serve the educational and informational needs of children" (or "core programming"). Second, the Commission adopted a definition of "core programming" that provides better guidance to broadcasters about what programs fulfill their statutory obligation to air programming "specifically designed" to educate and inform children. Third, to provide certainty to broadcasters about how to comply with the CTA and to facilitate the Commission's processing of license renewal applications, the Commission adopted a processing guideline pursuant to which a broadcaster can receive staff-level approval of its renewal application by airing either at least three hours per week of core programming, or somewhat less than three hours per week of such programming but otherwise demonstrating an equivalent level of commitment to educating children.

Children's TV Obligations of Digital TV Broadcasters

This Notice of Proposed Rule Making sought comment on a range of issues related to the obligation of digital television (“DTV”) broadcasters to serve children. This proceeding focussed primarily on two areas: the obligation of television broadcast licensees to provide educational and informational programming for children and the requirement that television broadcast licensees limit the amount of advertising in children’s programs.

Children's TV Programming Filing Requirements for Broadcasters
|
This Report and Order made a number of changes to the children’s educational television reporting requirements of commercial broadcast television licensees. The Commission extended indefinitely the requirement that commercial broadcast television licensees file with the Commission their quarterly Children’s Television Programming Reports (FCC Form 398). The Commission’s previous rules stated that such reports shall be completed quarterly and filed on an annual basis for an experimental period of three years, from January 1998 through January 2000. These reports are required to be filed electronically. Also, a number of revisions to FCC Form 398 were made to make the information contained in the form clearer and more useful to the public and the FCC. The R &O also adopted a Further Notice of Proposed Rulemaking to seek comment on whether broadcasters should be required to provide their completed Children’s Television Programming Reports at their own websites.
