The Commerce Department's Bureau of Export Administration (BXA) announced today that a $10,000 civil penalty has been imposed on Mr. Don Yamaguchi of Houston, Texas, doing business as Kaiyo USA. Yamaguchi agreed to the penalty to settle allegations that he caused the filing of a false statement by a U.S. exporter in violation of the Export Administration Regulations.
BXA alleged that, in September 1996, in connection with an export of satellite modems, Yamaguchi advised a U.S. exporter that the modems were to be exported from the United States to Japan when, in fact, Japan was not the country of ultimate destination. Based on this information, the U.S. exporter made a false statement on its Shipper's Export Declaration for the transaction when it represented that the modems ultimately were destined for Japan.
Assistant Secretary of Commerce for Export Enforcement Michael J. Garcia stated, "Imposition of this penalty illustrates the responsibility of each party to an export transaction to provide accurate and complete information for export documentation."
The Department of Commerce, through BXA, administers and enforces export controls for reasons of national security, foreign policy, nonproliferation, anti-terrorism, and short supply. Criminal penalties and administrative sanctions can be imposed for violations of the Export Administration Regulations.
Assistant Secretary Garcia commended Special Agent Tracy Martin, from the Dallas Field Office, who investigated the case in conjunction with agents from the U.S. Customs Service.
