    301.15 Automated Systems

    In accordance to City ordinance "Information Services Committee," § 2-6-3-1 through 2-6-3-3 ROA 1994, the Information Services Committee’s role is to "evaluation of information technology within the City government." As part of this role, the Information Services Committee (ISC) shall establish policies concerning automated systems (i.e., computerized systems). These policies will be published on the City’s website.

    The Information Services Committee (ISC) ratified the existence of a Technical Review Committee (TRC) for the technical review of information technology projects and purchases. Authority is delegated to the TRC to establish information technology procedures, standards and guidelines. Procedures, standards and guidelines established by TRC must conform with and relate to ISC policies and shall be published on the City’s website.

    All City employees, and personnel working on behalf of the City, must comply with the policies approved by the ISC and comply with the procedures, standards and guidelines established by TRC.

    Applies to all software installed on City equipment or used by City employees while performing their work duties.

    Policy
    Each Department must provide a sufficient number of licensed copies of software such that workers can get their work done in an expedient, effective and legal manner. Departments must make appropriate arrangements with the involved vendor(s) for additional licensed copies if and when additional copies are needed for business activities. It is each Department’s responsibility to effectively manage the software used by its employees, ensuring that workers are complying with federal, state and City copyright and software usage laws.

    Users (i.e., City employees or personnel working on the City’s behalf) must refrain from knowingly violating license agreements and/or requirements. Third party copyrighted information or software, that a Department does not have specific approval to store and/or use, must not be stored on City systems or networks. The City reserves the right to remove such information and software unless the involved Department can provide proof of authorization from the rightful owner(s).

    City employees, or personnel working on the City’s behalf, may use software only in accordance with vendor license agreements. In particular, unless authorized by the software developer, it is illegal to make copies on disk, tape, or otherwise, of software (programs, applications, operating systems, etc.) that bear the copyright symbol and/or a copyright number. Anyone caught making, acquiring, or using unauthorized copies of computer software will be subject to appropriate disciplinary action, to include termination. According to the U.S. Copyright Law 17 U.S.C. Section 504, illegal reproduction of software can be subject to civil damages of $100, 000 or more, and criminal penalties including fines and imprisonment.

    Rationale
    The City licenses the use of computer software from a variety of outside companies and normally do not own the software or its related documentation. Unless authorized by the software developer, the City does not have the right to reproduce it. The City is committed to managing its software assets for maximum benefit to the organization and its employees, while abiding by all federal, state and local laws, to include laws pertaining to the use of copyrighted software.
