H.R. 3338 – Department of Defense Appropriations Act, 2002

1. Open rule.

2. Waives all points of order against consideration of the bill.

3. Provides one hour of general debate equally divided and controlled by the chairman and ranking minority member of the Committee on Appropriations.

4. Provides that the bill shall be considered for amendment by paragraph.

5. Provides that the amendment printed in the Rules Committee report accompanying the resolution shall be considered as adopted.

6. Waives points of order against provisions in the bill, as amended, for failure to comply with clause 2 of rule XXI (prohibiting unauthorized or legislative provisions in a general appropriations bill or prohibiting reappropriations in a general appropriations bill), except as specified in the rule.

7. Waives points of order during consideration of the bill against amendments for failure to comply with clause 2(e) of rule XXI (prohibiting non-emergency designated amendments to be offered to an appropriations bill containing an emergency designation).

8. Authorizes the Chairman of the Committee of the Whole to accord priority in recognition to Members who have pre-printed their amendments in the Congressional Record.

9. Provides one motion to recommit with or without instructions.

RESOLUTION

Resolved, That at any time after the adoption of this resolution the Speaker may, pursuant to clause 2(b) of rule XVIII, declare the House resolved into the Committee of the Whole House on the state of the Union for consideration of the bill (H.R. 3338) making appropriations for the Department of Defense for the fiscal year ending September 30, 2002, and for other purposes. The first reading of the bill shall be dispensed with. All points of order against consideration of the bill are waived. General debate shall be confined to the bill and shall not exceed one hour equally divided and controlled by the chairman and ranking minority member of the Committee on Appropriations. After general debate the bill shall be considered for amendment under the five-minute rule. The amendment printed in the report of the Committee on Rules accompanying this resolution shall be considered as adopted in the House and in the Committee of the Whole. Points of order against provisions in the bill, as amended, for failure to comply with clause 2 of rule XXI are waived except as follows: "to be derived from the Airport and Airway Trust Fund and" on page 183, lines 24 and 25; "to be derived from the Airport and Airway Trust Fund and" on page 184, lines 7 and 8; "to be derived from the Highway Trust Fund and" on page 184, lines 18 and 19. Where points of order are waived against part of a paragraph, points of order against a provision in another part of such paragraph may be made only against such provision and not against the entire paragraph. During consideration of the bill for amendment, the Chairman of the Committee of the Whole may accord priority in recognition on the basis of whether the Member offering an amendment has caused it to be printed in the portion of the Congressional Record designated for that purpose in clause 8 of rule XVIII. Amendments so printed shall be considered as read. During consideration of the bill, points of order against amendments for failure to comply with clause 2(e) of rule XXI are waived. At the conclusion of consideration of the bill for amendment the Committee shall rise and report the bill, as amended, to the House with such amendments as may have been adopted. The previous question shall be considered as ordered on the bill and amendments thereto to final passage without intervening motion except one motion to recommit with or without instructions.

Walsh - Strikes the provision in Chapter 7, Department of Labor, under the heading “Employment and Training Administration, Training and Employment Services,” which provided $1.5 billion for the new National Emergency Grant program; reduces the amount available for FEMA Disaster Relief in Chapter 12 by $555 million; and creates a new Chapter 14 with the funds derived from the two aforementioned actions which would provide $12 million for the CDC, $10.5 million for the National Institute of Environmental Health Sciences, $1.825 billion for additional Community Development Grants through HUD to assist rebuilding and retraining of businesses and other economic development activities specifically in that part of New York City impacted by the events of September 11th, $32.5 million for training and employment services to be provided through the Consortium for Worker Education, and $175 million for worker compensation processing and claims programs in the State of New York.
