AGREEMENT ESTABLISHING AN ALLIANCE BETWEEN THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION U. S. DEPARTMENT OF LABOR THE NEBRASKA DEPARTMENT OF LABOR, WORKFORCE DEVELOPMENT OSHA CONSULTATION PROGRAM AND THE STATE OF NEBRASKA OFFICE OF HIGHWAY SAFETY
The Occupational Safety and Health Administration (OSHA); the Nebraska Department of Labor, Workforce Development, OSHA Consultation Program; and the State of Nebraska Office of Highway Safety (NOHS) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and NOHS hereby form an Alliance to promote roadway work zone safety by providing roadway users with information, guidance, and access to training resources that will help them understand and appreciate the risks associated with roadway work zones and better protect the health and safety of employees working in these areas. It is also the intention of this Alliance to reduce injuries and fatalities associated with employment in trucking terminals, particularly in reducing struck-by and run-over incidents. OSHA, Consultation, and NOHS will work together to achieve the following training and education goals: Develop training and education programs focusing on Nebraska fatalities, including causes, preventative measures, and information related to these fatalities, particularly those related to roadway work zones and trucking terminals. Deliver or arrange for the delivery of training on roadway work zone safety and trucking terminal safety, to be presented to Nebraska contractors and regulatory agencies. Inform businesses of the educational products and services available to them to assist them in complying with Federal and State safety and transportation obligations. OSHA, Consultation, and NOHS will work together to achieve the following outreach and communication goals: Develop information on the recognition and prevention of roadway work zone and trucking terminal hazards and disseminate information through existing and developing technologies to other Agencies, contractors, trucking companies, and other interested stakeholders. Communicate information developed by the Alliance to affected stakeholders through presentations, exhibits, or appearances at conferences, local meetings, or other similar events as opportunities present themselves. Promote and encourage employer participation in OSHA’s cooperative programs such as compliance assistance, the Voluntary Protection Program, Consultation, and Safety and Health Achievement Recognition Program (SHARP). OSHA, Consultation, and NOHS will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health as it pertains to safety in roadway work zones and safety at trucking terminals: Raise awareness of and demonstrate commitment to work place safety and health whenever OSHA and NOHS leaders address groups. Convene or participate in forums, round table discussions, or stakeholder meetings on roadway work zone and trucking terminal safety and health issues to help forge innovative solutions in the workplace. OSHA’s Alliances provide parties an opportunity to participate in a voluntary, cooperative relationship with OSHA for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health. These alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the agency enter into an Alliance with the purpose of promoting a particular party’s products or services. An implementation team made up of representatives from all Alliance organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Alliance participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of the Alliance. This agreement will remain in effect for two years from the date of signing. Any signatory to This Alliance may terminate the agreement for any reason at any time, provided they give 30 days written notice.
