Strategic Alliance Memorandum With the U.S. Small Business Administration and the Occupational Safety and Health Administration - U.S. Department of Labor Lubbock Area Office/El Paso District Office |

The Occupational Safety and Health Administration (OSHA) and the Small Business Administration (SBA) (individually a "Party" or collectively "Parties”) agree to establish a Strategic Alliance Memorandum (SAM) to promote safe and healthful working conditions for workers in the EI Paso, Texas area and also to help people get into, stay in, expand and improve their small businesses in the El Paso, Texas area. OSHA and SBA hereby form a strategic alliance to provide employers with information, guidance, and access to training resources that will help them provide to their employees knowledge of safety and health hazards of construction and general industry with a focus on the four major hazards: 1) falls 2) electrical 3) struck by and 4) caught in between. The Parties also hope to increase awareness among the small business community of SBA opportunities, such as training. The Parties will work together in the spirit of cooperation and open communications, consistent with law, with the primary goal of meeting the needs of the small business community. The mission of the SBA is to aid, counsel, assist and protect the interests of small business by providing financial, contractual and business development assistance and advocating on their behalf within the government. SBA district offices deliver SBA programs and services to the public. Each Party has separate services and resources which, when delivered in coordination with each other, will provide maximum benefits to the small business communities served. The purpose of this SAM is to develop and foster mutual understanding and a working relationship between the SBA and OSHA in order to achieve optimal effectiveness of SBA's and OSHA'S business development programs for the benefit of small businesses. The Parties acknowledge that specific joint training and outreach activities contemplated under this SAM require further negotiations and a separate written agreement developed pursuant to SBA' s co-sponsorship authority. Nothing in this SAM permits either Party to use the other Party's logo or seal The "U.S. Small Business Administration” and the "Occupational Safety and Health Administration" names shall be used only in a factual manner and consistent with applicable law, and shall not promote or endorse any products or services of any entity including but not limited to the other Party. LOCAL OSHA UNDERTAKINGS: Within the limits of its available and/or appropriated resources, OSHA will work to achieve the following training, education and outreach goals:
An implementation team made up of representatives of the Parties will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, the team will meet periodically to track and share information on activities and results in achieving the goals of the SAM. This SAM will remain in effect for two years from the date of signature. Either Party may terminate it for any reason at any time, upon thirty (30) days written notice to the other Party. This SAM may be modified at any time only with the written concurrence of both Parties. This agreement does not itself authorize the expenditure of any funds. Accordingly, this agreement shall not be interpreted as creating any binding legal obligations between the Parties nor shall it limit either Party from participating in similar activities or arrangements with other entities. Nothing contained herein shall be construed to create any association, partnership, joint venture or relation of principal or agent or employer and employee with respect to OSHA and SBA.
