CHARGE       :  "The article is subject to refusal of admission pursuant to
                Section 801(a)(3) in that it appears to have been prepared,
                packed or held under insanitary conditions whereby it may
                have been rendered injurious to health [Adulteration,
                Section 402(a)(4)]."

REASON FOR
ALERT        :  On December 20, 1988, CIN-DO examined a shipment of Fresh
                Black Truffles which were packed in sealed clear plastic
                bags and were neither refrigerated nor labeled.  The bags
                were swollen and contained some cloudy liquid in the
                bottom.

INSTRUCTIONS :  Automatically detain, without sampling or analysis all
                shipments of fresh black truffles from P. Pebeyre, Cahors,
                France and any other manufacturers/ shippers when wharf
                exams reveal that they are packed in sealed plastic bags
                and are not or have not been refrigerated.  When entry
                documents list truffles, determine the type of containers
                involved (i.e., metal cans, glass jars or plastic bags).
                Truffles, if in cans or glass, are likely to be low-acid
                canned foods which have been thermally processed and the
                manufacturer should be registered and have processes filed
                with FDA.
