INFORMATION ASSOCIATED WITH CATEGORY I FUEL

The Commission has approved implementation of Option 3, with some modification, to apply
NRC's guidance for Sensitive Unclassified Non-Safeguards Information (SUNSI) to documents
related to the Category I fuel facilities [Nuclear Fuel Services (NFS) in Erwin, Tennessee and
BWX Technologies, Inc. (BWXT) in Lynchburg, Virginia] and to prepare and release redacted
versions of documents containing SUNSI. With regard to historical documents discussed in the
SECY paper (January 2004 to present), the staff should perform a review of a subset of
documents generated that are not publicly available in ADAMS. The subset of documents
should include inspection reports, licensee performance reviews, enforcement actions (non-Order), event reports, and other documents which the staff determines to be relevant. The staff
should ensure that this subset provides the public with a record of NRC's regulatory actions.
Additionally, the staff shall ensure the requirements of section 189 of the Atomic Energy Act are
met in making information regarding proposed license amendments and proposed Orders
available to the public. Future documents associated with Category I fuel facilities containing
SUNSI should be redacted and made publicly available.
The Chief Financial Officer should fund this activity from FY 2007 carryover funds, so as not to
require the staff to delay decisions on two fuel cycle facility license renewals.
