CAP Vendor Bidding Concluded; Bidding Reminders

The 2009-2011 CAP vendor bidding period concluded on February 15, 2008.  Submitted applications are now being evaluated.  After the evaluation process is complete and contracts have been signed later this year, CMS will announce the names of the Approved CAP Vendors to the public.  The document 'Bidding Reminders' from the Downloads section has been removed and the reminders can now be found in the "Related Links Inside CMS" section below

CAP Vendor Bidding January 14 – February 15, 2008

CMS has released a solicitation for contracts to be awarded to vendors to supply drugs for the CAP.  From January 14 - February 15, 2008, CMS will open bidding to entities interested in participating as Approved CAP Vendors for the Competitive Acquisition Program (CAP) for 2009-2011. 

A three year contract for 2009-2011 will be awarded to vendors for each program geographic area who have and maintain: 1) sufficient means to acquire and deliver competitively biddable drugs within the specified contract area; 2) arrangements in effect for shipping at least 5 days each week for the competitively biddable drugs under the contract and means to ship drugs in emergency situations; 3) quality, service, financial performance, and solvency standards; and 4) a grievance and appeals process for dispute resolution. Up to five vendors may be selected.  Approved CAP vendors must also qualify for enrollment in Medicare. 

For 2009-2011, the CAP will continue to have one geographic area. 

A vendor, including any of its subcontractors, subsidiaries, or business affiliates, must also be licensed in accordance with state and Federal requirements and in a manner that will allow the applicant to supply CAP drugs in all 50 States, the District of Columbia, Puerto Rico, The United States Virgin Islands, American Samoa, Guam and the Northern Mariana Islands.

Interested parties may submit vendor applications to CMS beginning January 14, 2008 until February 15, 2008. 

Vendor Applications

Applicant vendors must be enrolled as a Medicare supplier to be eligible for selection as an approved CAP vendor. A valid NPI is required for enrollment as a Medicare supplier.  Additional information about the 855 application process and NPIs may be found at the CAP Designated Carrier's website (see 'Related Links Outside CMS' section below).

The application period will run from January 14, 2008 - February 15, 2008. Applications will be accepted through 5:00 PM EST on Friday, February 15, 2008.

Applicants must submit the following documents: 

  • The "Vendor Application and Bid Form" and the "Drug Bid Form" (Excel spreadsheet)
    • Two electronic copies on compact discs (CDs), AND
    • One original signed paper copy of each form must be submitted.
  • CMS Form 855B
  • One original signed paper copy and one copy of the completed form must be submitted.

Open Door Forum for the 2009-2011 Approved CAP Vendor Bidding Period

On January 10, 2008, the Centers for Medicare & Medicaid Services (CMS) hosted a Special Open Door Forum (ODF) for the Competitive Acquisition Program (CAP).  Representatives from CMS and the CAP designated carrier presented information and answered questions about the CAP and the bidding process to entities interested in bidding to be an approved CAP vendor.

CAP Designated Carrier

Noridian Administrative Services (NAS) is the CAP Designated Carrier.  Noridian is responsible for enrolling Approved CAP Vendors, processing CAP drug claims, responding to vendor, physician, and beneficiary questions related to the CAP, and administering the CAP dispute resolution process.  The Noridian Administrative Services CAP web site can be found in the "Related Links Outside CMS" below.

Information on 2009 Vendor bidding

CMS anticipates releasing a solicitation for contracts to be awarded to vendors to supply drugs for the CAP.  These vendor contracts would be effective January 1, 2009 to December 31, 2011. CMS anticipates that the vendor bidding period will begin on January 14, 2008 and end on February 15, 2008.

Additional information about bidding for the CAP 2009-2011 approved vendor contract, including bid forms and drug lists will be posted on or about January 14, 2008.
