  • Canada Notifies its Intent to Amend Fish Inspection Regulations for Salted and Dried Fish
    The Canadian Food Inspection Agency notified the WTO of its intent to amendment its Fish Inspection Regulations (FIR) to: (1) better facilitate the marketing of salted fish in the international marketplace through the revision and updating of the sections of the FIR pertaining to salted fish and salted fish products so that they correspond to present processing practices made possible through technological advances in the industry, as well as to changes in market requirements; (2) provide the industry with flexibility to meet marketplace demands and specifications by: (a) defining the minimum criteria for salted fish, (b) defining the criteria for the voluntary use of product presentations and classes, (c) removing compulsory grades and grade standards, and (d) permitting greater flexibility in the labeling of salted fish and salted fish products destined for the international marketplace; and (3) continue to achieve, in the process, appropriate levels of food safety and consumer protection. The notification was published in the Canada Gazette, Part I, on March 12, 2005.

  • Norway Challenges the European Union's Safeguard Measures Against Imports of Farmed Salmon
    On February 9, 2005, the Norwegian government (GON) announced its decision to challenge the EU’s new safeguard measures against imports of farmed salmon at the WTO Dispute Settlement Body. The EU safeguard measures took effect on February 6, 2005. GON officials maintain that the safeguards, which include minimum import prices, tariff rate quotas and a financial guarantee mechanism, are unjustified and favor inefficient salmon farmers in Ireland and Scotland at the expense of the more efficient Norwegian fish farming industry.

  • Quarantine Requirements for the Importation of Live Crustaceans for Aquaculture
    The People's Republic of China (Taiwan)

    Taiwan's Council of Agriculture (COA) on April 12, 2004, publicly announced the new "Quarantine Requirements for the Importation of Live Crustaceans for Aquaculture" (attached). The Bureau of Foreign Trade (BOFT) on April 26, 2004 notified AIT/Taipei, together with representative offices from other countries, of the announcement. The new requirements, referenced to OIE Aquatic Manual, would require aquatic animal health certificates for six categories of live crustaceans imported for farming or breeding purposes. The new requirements, to be in effect July 1, 2004, apply to consignments loaded on board a vessel or aircraft on or after July 1, 2004.

  • China Issues Rules Governing Import and Export Inspection Bodies
    On December 3, 2003, the Ministry of Commerce of the People's Republic of China (MOFCOM) posted on its website “Measures on the Administration of Inspection Bodies for Commodity Imports and Exports”, which was officially issued on September 4, 2003, by MOFCOM, China’s Administration for Quality Supervision, Inspection and Quarantine (AQSIQ), and the State Administration for Industry and Commerce (SAIC). The Measures will govern the licensing and administration of inspection bodies and branches for commodity imports and exports. The rules cover both compulsory and voluntary commodity inspections. Inspection bodies may be domestic, China-foreign, joint-venture, cooperative or wholly foreign owned. Wholly foreign owned inspection bodies would not be allowed until December 11, 2005. Establishment of domestic inspection bodies must be licensed by AQSIQ and registered with SAIC. Foreign-funded inspection bodies must go through MOFCOM licensing procedures in addition to the above-mentioned procedures, though half of the application documentation required by MOFCOM overlaps with that required by AQSIQ. Once approved by MOFCOM, the inspection bodies may obtain 3-year qualification certificates from AQSIQ. While the Measures take effect on January 1, 2004, they have not been notified to the World Trade Organization.
