Honey Creek Cattle Co., dba Peace Livestock, James L. Thurn and Deryl D. Hines are Charged with Violating the Packers and Stockyards Act

 
WASHINGTON, September 11, 2008-? The U.S. Department of Agriculture's Grain Inspection, Packers and Stockyards Administration (GIPSA) entered into a consent decision with Honey Creek Cattle Co. (Honey Creek) doing business as Peace Livestock, James L. Thurn (Thurn) and Deryl D. Hines (Hines), Edgewood, Iowa.

 
Honey Creek, Thurn and Hines have been ordered to cease and desist from:

 
  • failing to pay the full purchase price for livestock;
  • failing to pay for livestock purchased within the time period required by the Packers and Stockyards (P&S) Act; and
  • issuing checks for livestock purchases without having sufficient funds to cover checks.

 
Honey Creek, doing business as Peace Livestock, has been suspended as a registrant under the P&S Act for eight years. Thurn and Hines have been suspended as registrants for eight years as well. A Supplemental Order may be issued permitting them employment if they demonstrate that six years of their suspension has been fully served and that a suitable registrant or packer is willing to provide bona fide salaried employment during the balance of the eight-year suspension period.

 
The decision resolves charges that were filed on June 19, 2008, in which GIPSA alleged Honey Creek, Thurn and Hines:

 
  • failed to pay the full purchase price for the purchase of livestock;
  • purchased livestock and failed to pay within the time period required by the P&S Act; and
  • issued checks for livestock purchases without having sufficient funds to cover checks.

 
The P&S Act is a fair trade practice and payment protection law that promotes fair and competitive marketing environments for the livestock, meat, and poultry industries.
