Alexander Carr Smith is Assessed a Civil Penalty in the Amount of $6,000

WASHINGTON, April 9, 2008 - On January 11, 2008, the Grain Inspection, Packers and Stockyards Administration (GIPSA) entered into a default decision with Alexander Carr Smith (Smith), Church Hill, Tennessee.

Smith has been ordered to cease and desist from buying and selling livestock in commerce on a commission basis without maintaining an adequate bond.

Smith was also assessed a civil penalty in the amount of $6,000.

The decision resolves charges that were filed on July 12, 2007, in which GIPSA alleged that Smith failed to maintain an adequate bond in spite of a February 22, 2001, order to Smith by Administrative Law Judge Hunt. Judge Hunt ordered Smith to cease and desist from engaging in business that requires a bond without maintaining an adequate bond.

The P&S Act is a fair trade practice and payment protection law that promotes fair and competitive marketing environments for the livestock, meat, and poultry industries.
