My husband is presently incarcerated; are my son and I eligible for any benefits?
  Question
My husband is presently incarcerated and does not receive social security benefits. Are my son and I eligible for any benefits while he is in jail?
  Answer

If you, your son and your husband were receiving Social Security benefits prior to his incarceration, benefits to you and your son could continue while he is incarcerated.  However, if your husband was not receiving Social Security benefits prior to his incarceration, no benefits can be paid to you or your son during his incarceration.

You should contact your social services/welfare department to find out if there are other locally sponsored programs that can provide assistance to you.
