NTEU and U. S. Customs Service, Washington, D.C. Case No. 0-NG-2637 (Decided September 25, 2003)
The proposals in this case required the Agency to engage in mid-term bargaining, either over Agency-initiated changes (Proposal 1) or over Union requests for mid-term bargaining (Proposal 2), unless the subject matter of bargaining is specifically addressed in the parties' National Agreement or an existing Memorandum of Understanding. The Authority found that the proposals were negotiable at the election of the Agency.
